TERMS & CONDITIONS FOR MIND THE GAP ONLINE COURSES

These terms & conditions apply to anyone starting a course with “Mind the Gap” (Brand Name). These terms and conditions are a contract between you (student) and Mind The Gap. Mind The Gap is the training academy of Mash Communications (UK) Ltd.

The Terms and Conditions set out below and our Privacy Policy together constitute the legal agreement between you and Mind The Gap relating to the provision of training courses.

All online courses are provided by Mash Communications (UK) Ltd under the brand name “Mind The Gap”, registered business address 82 The Greenhouse, MediaCityUK, Salford, M50 2EQ; registered number: 08018568 (England and Wales)

Mind The Gap is the training academy of Mash Communications (UK) Ltd. The company name will be referred to as “Mind The Gap” herewith.

All intellectual property rights, including copyright in all content and communication belongs to Mind The Gap. By reading the Terms of Use you are agreeing that the content and property of Mind The Gap cannot be copied, reproduced, modified, stored, redistributed or exploited commercially in any way without permission from Mind The Gap.

Mind The Gap may change the content, which includes prices, offers and content at any time. We do not provide a warranty or guarantee of its accuracy, completeness, suitability, timeliness or performance of information or content in the website. If there are errors in the information provided in the content of the website we expressly exclude liability for these inaccuracies, to the fullest extent that the law permits.

You can use any of the information or content at your own risk for which Mind The Gap will not be liable. It will be your responsibility to ensure that any products you purchase are suitable to your current requirements.

Use of Site

Mind The Gap provides various materials, information, quizzes, tests, questions, articles, news and other information on this and related sites and in courses offered through this site (the “Materials”). Mind The Gap authorises each User to view and download one copy of the Materials. Materials may be downloaded and a maximum of one copy of the Materials may be printed provided that Users make no modifications to the Materials and you retain all copyright and other proprietary notices contained in the original Materials on any copies of the Materials. Users may not modify the Materials at this Site in any way or reproduce, share or distribute them. Users will keep all Materials confidential, and will not sell, auction, loan, rent, give away, describe, summarize, or otherwise reveal the Materials or their contents, to any other person or entity. Any breach of these Terms of Use automatically terminates your authorized use of the Site.

Trademark and Copyright

Mind The Gap and certain other brands, trademarks, and service marks are marks of Mind The Gap and its affiliates. The Materials on this Site are copyrighted, and any unauthorized use of any Materials on this Site may violate copyright, trademark, and other laws.

Mind The Gap has not reviewed all of these external websites, does not control and is not responsible for any of these sites or their content. Mind The Gap has the right to not accept a booking.

If a booking request is made using the Mind The Gap website or associated Mind The Gap course websites powered by Thinkific, you will receive an automatic email confirming we have received your booking request. All bookings are subject to availability.

By booking and starting a course with Mind The Gap you (the student) confirms that you meet the following minimum requirements of the course:

• All students must be 18 years old at the time of booking
• All students must have a competent level of English to study the courses as all courses are presented in English

By making a booking with Mind The Gap it is assumed the student satisfies the above conditions. The student, by making a booking, takes full responsibility in determining whether the course is suitable for their own level in English.

The fee to attend a course must be paid in full on booking and before the start of the course.

Mind The Gap has the right to refuse an attendee entry to the course if the course fee is not paid before commencement of the course.

All prices that are advertised on our website and promotional literature are correct at the time of booking. Mind The Gap reserves the right and discretion to change and amend our prices at any time. Please check the website for the latest offers before you purchase. Once a course is purchased, the cost will immediately be charged.

Cooling off Period:

Under the Consumer Protection (Distance Selling) Regulation 2000 you the consumer have the legal right to cancel the contract between you and Mind The Gap during the period of 12 hours from date of purchase providing none of the course literature has been downloaded and none of the course undertaken. Should any aspects of the course have been downloaded it is 100% non-refundable.

This is known as the “cooling off period”. If you decide to cancel the course within this cooling off period then you must inform us within the 12 hours of the confirmation of booking the course. Once we receive your written cancellation, in form of an email we will refund your course fees within 30 days.

Once you have completed the cooling off period of 12 hours you will be under the full cancellation conditions of courses which are 100% non-refundable.

Launch offer (July 2021 - October 2021)

If you complete the 10 weeks, complete all the worksheets 100% and invest in yourself and completing the modules AND if you don’t learn anything about how to press play, how to stop procrastinating, how to look after yourself a bit better so you can thrive, I’ll refund the cost of the course.

Mind The Gap has the right to cancel a course. In this event Mind The Gap will reimburse in full any course fees paid and Mind The Gap’s liability will be limited to the value of the course fees paid.

In no event will Mind The Gap, its suppliers, or other third parties mentioned at this Site be liable for any damages whatsoever (including, without limitation, those resulting from lower test scores, interruption of services or inaccurate information) arising out of the use, inability to use, or the results of the use of this Site, any websites linked to this Site, or the Materials or information contained at any or all such sites, whether based on warranty, contract, tort or any other legal theory and whether or not advised of the possibility of such damages. If your use of the Materials or information from this Site results in the need for servicing, repair or correction of equipment or data, you assume all costs thereof.

If at any time, you are unhappy with the Mind The Gap service then please contact us immediately at sarah@mindthegap.academy and we will endeavour to respond as quickly as possible but no more than 30 days following the receipt of your complaint.

Any personal data supplied by the customer can be processed by Mind The Gap on the legal bases and for the purposes set out in the Privacy Policy, which is freely available here www.mindthegap.academy

These terms and conditions and any dispute or claim arising out of and in connection with them or their subject matter (including no contractual disputes or claims) shall be governed by and shall be construed in accordance with English Law and the Courts of England and Wales shall have exclusive jurisdiction over any claim arising out of it.

Mind The Gap reserves the right to change any of these conditions at any time deemed necessary to reflect current market and economic conditions.

The Course and the relevant login details are solely for your use. Another party cannot use these details.

By reading these terms and conditions or making payment on the website for a selected course you are accepting all terms and conditions of Mind The Gap.

Mind The Gap reserves the right to change any of the content, material, prices, offers or time period of the courses at any time. We advise you to read and accept the terms and conditions at the time of booking.
